Acceptance of Terms
These Terms of Service ("Terms") govern your use of the Dyskvr Discord bot, this website and the dashboard (together, the "Service"). By adding the bot to a server, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Eligibility
You must be old enough to use Discord under its Terms of Service (at least 13, or higher where local law requires). If you use the Service on behalf of a server or organization, you confirm that you have the authority to accept these Terms for it.
Discord Requirements
The Service operates on Discord. You must follow the Discord Terms of Service, the Community Guidelines and Discord's Developer Policy at all times. We are not affiliated with or endorsed by Discord Inc.
Your Account and Access
- You sign in through Discord. You are responsible for all activity carried out through your Discord account on the dashboard.
- Dashboard access to a server is limited to its owner and members with the Administrator permission. You must not try to access servers or data you are not authorized to manage.
- Keep your Discord account secure. Tell us promptly if you believe your access has been compromised.
Acceptable Use
You agree not to:
- Break any law, or use the Service to harass, threaten, exploit or harm others.
- Attempt to hack, probe, overload, or disrupt the Service, or bypass its security, permissions or rate limits.
- Scrape, reverse engineer, or copy the Service beyond what the law allows.
- Use the Service to distribute malware, spam, phishing, or illegal or infringing content.
- Use automation, self-bots or exploits to abuse commands or features.
- Resell or misrepresent the Service without our written permission.
Server Administrators
If you add the bot to a server or configure it through the dashboard, you are responsible for how it is used there. That includes the permissions you grant it, the settings you choose, the content you publish through it, and informing your members about any data the bot handles in your server.
Your Content
You keep ownership of anything you submit or configure through the Service. You give us a limited license to store, process and display that content only as needed to operate and improve the Service. You are responsible for making sure you have the rights to what you submit.
Intellectual Property
The Service, including its code, design, logo, name and branding, belongs to us or our licensors and is protected by applicable laws. These Terms give you a limited, revocable, non-exclusive right to use the Service. They do not transfer any ownership to you.
Premium Subscriptions and Payments
- Premium is an optional paid plan that applies to one server. Prices are shown in US dollars on the dashboard before you pay.
- Payments are processed by Stripe. We never see or store your card details.
- Subscriptions renew automatically each month or year until cancelled. You can cancel at any time from the billing portal, and Premium stays active until the end of the period you already paid for.
- Features listed as "Coming soon" are planned and may change before release.
- For billing questions or refund requests, contact us through the support server. We review requests case by case.
- We may grant or remove Premium manually, for example for partnerships, or if these Terms are broken.
Server Websites
- The Website Builder lets server owners and administrators publish a website. You are responsible for everything you publish, including text, images and links.
- You must have the right to use any images or content you add. Do not publish illegal, hateful, harassing, sexual, deceptive or infringing content, or links to malware or scams.
- Communities that use "Emergency Response: Liberty County" content must not suggest they are run by, or endorsed by, Roblox or the game's creators.
- We may shut down, disable or delete any website at any time, for example if it breaks these Terms, and we are not required to give notice.
- Premium website styles need an active Premium plan to be edited or published. If Premium ends, a published site keeps its content but is shown in a free style.
Discovery Listings and Reviews
- Discovery is a public directory of ER:LC servers. A server is listed only after our staff approves its application, and we may reject, hide, suspend or remove any listing at any time.
- Server owners are responsible for everything on their listing, including the description, banner, invite link, announcements and events. Information must be accurate and must not mislead people.
- Anyone signed in can post one review per server. Reviews must be honest, based on your own experience, and must not contain harassment, hate, spam or private information. You cannot review a server you manage.
- We may remove reviews and listings that break these Terms. Listings and reviews are public.
Availability and Changes
We aim to keep the Service running, but we do not guarantee uninterrupted or error-free operation. We may add, change, limit or remove features, including paid or premium features, at any time with or without notice.
Suspension and Termination
We may suspend or block your access, or blacklist a user or server, at any time if we believe these Terms have been broken, the Service is being abused, or we must do so to comply with the law or Discord's rules. You may stop using the Service at any time by signing out and removing the bot from your servers.
Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, reliability and non-infringement. Use it at your own risk.
Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, members or reputation, arising from your use of or inability to use the Service. Where liability cannot be excluded, it is limited to the amount you paid us for the Service in the previous 12 months, or zero if you paid nothing.
Indemnification
You agree to defend and hold us harmless from claims, damages and expenses arising from your misuse of the Service or your breach of these Terms.
Changes to These Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. If you keep using the Service after changes take effect, you accept the updated Terms.
Governing Law
These Terms are governed by the laws of the jurisdiction in which the Service's operator is based, without regard to conflict-of-law rules. Any disputes will be handled by the competent courts of that jurisdiction unless local consumer law says otherwise.
